Copyright Policy | Fourth Idly

Fourth Idly respects the intellectual property rights of creators, organisations, Users, and other rights holders. This Copyright Policy explains ownership of Fourth Idly’s Platform materials, rights in User-generated content, the process for reporting suspected copyright infringement, the process for responding to a valid counter-notice, and Fourth Idly’s approach to repeat infringement.

This Policy applies to content and materials made available through the Fourth Idly mobile application and related Platform services, including Need Requests, Donation information, profile materials, chat, ratings, feedback, photographs, impact posts, NGO documentation, Volunteer documentation, and other content submitted or displayed through the Platform. It should be read together with the Fourth Idly Terms and Conditions, Privacy Policy, Community Guidelines, and Data Deletion Policy.

9.1 Ownership of Platform Content

All intellectual property rights in the Fourth Idly Platform — including the software, application interface, design, layout, original written content, logos, graphics, icons, visual elements, trademarks, service marks, and other original materials created or licensed for Fourth Idly — are owned by Fourth Idly or its licensors, to the extent applicable.

Such materials may be protected under the Copyright Act, 1957 (India), the Trade Marks Act, 1999, and other applicable intellectual-property laws. Unauthorised reproduction, distribution, public display, modification, adaptation, reverse engineering, extraction, or commercial exploitation of Fourth Idly’s protected materials is prohibited except where expressly authorised by Fourth Idly or permitted by applicable law.

Do not copy or reproduce Fourth Idly’s application screens, original written materials, graphics, logos, or other protected content for a competing service without permission.
Do not remove copyright, trademark, attribution, or other proprietary notices from Platform materials.
Do not use the Fourth Idly name, logo, branding, or other marks in a way that suggests sponsorship, endorsement, affiliation, or authorisation without permission.
Do not sell, license, redistribute, or commercially exploit Fourth Idly’s proprietary Platform materials without appropriate authorisation.
Do not reproduce substantial portions of the Platform or its content through scraping, mirroring, systematic copying, or similar methods.

Nothing in this Policy prevents lawful uses that cannot legally be restricted, including applicable statutory exceptions, fair dealing or other permitted uses under Indian law.

9.2 User-Generated Content

Users may submit content to Fourth Idly in connection with Platform activity. Depending on the current application flow, this may include photographs, NGO activity or impact reports, Need Request descriptions, donation descriptions, profile photographs, ratings, feedback, chat messages, and other community content.

Users retain ownership of original content they create and have rights in, subject to the rights of third parties and any applicable licences. By submitting content to Fourth Idly, you grant Fourth Idly a non-exclusive, royalty-free, worldwide licence, to the extent necessary, to host, store, reproduce, display, format, adapt, transmit, and otherwise use that content in connection with operating, providing, securing, moderating, improving, and promoting the Platform, subject to applicable law and the Privacy Policy.

This licence does not transfer ownership of the User’s underlying copyright. It is intended to allow Fourth Idly to perform the functions for which the content was submitted, including displaying a Need Request to relevant Donors, showing relevant delivery information to participants, displaying ratings or impact posts, storing content in Platform infrastructure, and maintaining records necessary for safety, support, moderation, and dispute resolution.

Users represent and warrant that:

You are the original creator of the content or have all necessary rights, permissions, and licences to submit it.
The content does not infringe copyright, trademark, privacy, publicity, moral rights, or other rights of a third party.
You are authorised to grant the licence described in this Policy.
Any identifiable person appearing in photographs, videos, or other content has been treated in accordance with applicable privacy, consent, and legal requirements.
The content is not knowingly false, fraudulent, unlawful, defamatory, harassing, hateful, or otherwise prohibited by the Fourth Idly Community Guidelines or Terms and Conditions.

Users should be especially careful when uploading photographs or impact content involving beneficiaries, children, NGO staff, Donors, Volunteers, or other identifiable individuals. Appropriate consent or lawful authority should be obtained where required.

9.2.1 Content Submitted Through Current Platform Features

The current Fourth Idly flow may allow Users to submit or generate content through several features:

NGO Need Requests may contain item descriptions, quantities, required-by dates/times, pickup information, and other descriptive content.
Donation records may contain descriptions or information concerning offered food or products.
Profile photographs may be uploaded by Users as optional profile content.
NGO licence/registration PDFs and Volunteer driving-licence PDFs may be uploaded for administrative verification. These documents are primarily verification records and may contain third-party rights; Users must have lawful authority to submit them.
Chat messages are User-generated communications and should not contain copyrighted material that the User has no right to share.
Ratings and written feedback are User-generated content and must be truthful, relevant, and lawful.
Impact posts may contain photographs, captions, activity descriptions, or other material intended to communicate social impact.

Fourth Idly may process and display such content according to the relevant Platform workflow. The fact that content can technically be uploaded does not mean that the User has permission to upload material owned by another person.

9.3 Copyright Complaints

Fourth Idly respects intellectual-property rights and takes credible copyright complaints seriously. If you believe that content available through the Platform infringes your copyright, you may submit a written copyright complaint using the official Fourth Idly copyright or legal contact channel.

Fourth Idly may review a sufficiently detailed complaint and, where appropriate, restrict access to, remove, disable, or otherwise address allegedly infringing content. Fourth Idly may also contact the relevant User or request additional information where necessary to assess the complaint.

A copyright complaint should be made by the copyright owner or an authorised representative. Knowingly submitting a false or materially misleading infringement complaint may result in appropriate action.

9.4 Reporting Copyright Infringement

To file a copyright complaint, please send a written notice to Fourth Idly’s official copyright/legal contact address published by the Platform. A useful and complete notice should contain the following information:

A description of the copyrighted work that you claim has been infringed, including enough information to identify the work.
A description of the material that you believe is infringing and its location on the Platform, such as a URL, post identifier, listing identifier, profile, screenshot, or other platform-specific identifier.
Your full name and sufficient contact information, such as postal address, email address, and phone number, to allow Fourth Idly to contact you regarding the complaint.
A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
A statement that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner’s behalf.
An electronic or physical signature of the copyright owner or authorised representative.

Where possible, the complainant should also provide evidence supporting ownership or authority, such as a registration record, original publication information, licence documentation, or other material reasonably demonstrating the claimed right.

Fourth Idly will review valid and sufficiently detailed complaints as reasonably practicable. Depending on the circumstances, appropriate action may include removal or restriction of the reported content, contacting the submitting User, requesting clarification, or taking no action where the complaint is unsupported or the use appears lawful.

The handling of copyright complaints is subject to applicable Indian law, including the Copyright Act, 1957, and any other applicable legal requirements.

9.5 Counter Notice

If content submitted by you has been removed, restricted, or disabled following a copyright complaint and you believe the action resulted from mistake, misidentification, or another lawful basis for the content’s use, you may contact Fourth Idly through the official copyright/legal contact channel to request review.

A counter-notice should include:

Identification of the removed or restricted content and its former location on the Platform.
A statement explaining why you believe the content was removed or restricted by mistake or misidentification.
Your full name and contact details sufficient for Fourth Idly to communicate with you.
Information supporting your right to use the content, such as an ownership statement, licence, permission, public-domain basis, or other applicable legal exception.
A statement that the information provided is accurate to the best of your knowledge.
Your electronic or physical signature.

Where applicable and legally required, a counter-notice may also need to include consent to the jurisdiction of the appropriate court or other information required by applicable law.

Fourth Idly may review the counter-notice and the original complaint and may request additional information. Restoration of content is not automatic and may depend on the applicable law, the evidence received, the rights of the parties, and whether Fourth Idly is required or permitted to take further action.

Nothing in this section limits any rights or remedies available to a copyright owner or User under applicable law.

9.6 Repeat Infringers

Fourth Idly may take stronger action against Users who are found to be repeat infringers of intellectual-property rights.

Repeatedly submitting content that is found to infringe another person’s copyright or other intellectual-property rights.
Repeatedly uploading content after receiving credible notices concerning the same or substantially similar infringement.
Using multiple accounts to continue uploading infringing content after a restriction or termination.
Knowingly circumventing content restrictions imposed following legitimate copyright complaints.

Depending on the circumstances and applicable law, Fourth Idly may remove or restrict content, issue warnings, suspend particular features, suspend an account, block an account, or terminate access to the Platform.

Fourth Idly reserves the right to determine, based on the available evidence and circumstances, whether a User has engaged in repeated infringement. This determination will be made subject to applicable law and any rights available to the User.

9.7 Third-Party Materials and Licences

Users may encounter third-party materials through the Platform, including photographs, logos, product descriptions, organisation names, documents, maps, payment-related interfaces, and other content supplied by other Users or third-party services.

Fourth Idly does not automatically acquire ownership of third-party content merely because it is displayed or processed through the Platform. Users must respect the rights of the relevant copyright owners and licensors.

Do not download, reproduce, modify, or commercially exploit third-party content merely because it is visible in the application.
Do not use an NGO’s logo, photograph, report, or other protected material outside the scope of your lawful use.
Do not upload third-party photographs, reports, artwork, documents, or other materials unless you have permission or another lawful basis.
Do not assume that material found online is free to copy.

9.8 Copyright in NGO and Verification Documents

NGO licence/registration documents and Volunteer driving-licence documents may contain protected text, images, government marks, signatures, or other intellectual property belonging to the issuing organisation, authority, or individual.

These documents are collected for verification purposes within the Platform. Users must not copy, publish, distribute, or repurpose such documents outside the legitimate verification or Platform purpose without lawful authority.

Fourth Idly may store and process uploaded documents in its designated cloud infrastructure for verification, security, administration, dispute handling, and other lawful purposes described in the Privacy Policy.

9.9 Copyright and Impact Posts

Impact posts can include photographs, captions, reports, graphics, or other creative material. Users submitting such posts are responsible for ensuring that the material can lawfully be used by Fourth Idly for the Platform purposes described in this Policy.

Obtain appropriate permission before using another person’s photograph where required.
Do not copy another organisation’s impact report, photograph, campaign material, or written story and present it as your own.
Do not remove attribution or copyright notices from third-party material.
Do not upload stock photographs or internet images as if they depict an actual Fourth Idly donation or beneficiary unless you have the appropriate rights and clearly present them accurately.
Do not manipulate or fabricate impact material in a way that misrepresents the underlying donation or event.

9.10 Copyright and Chat, Ratings and Feedback

Chat, ratings, and feedback are intended for communication and Platform participation. Users should not use these features to reproduce substantial copyrighted works that they do not have permission to share.

Short quotations or references may be lawful in some circumstances, but Users are responsible for determining whether their particular use is authorised or legally permitted. Fourth Idly may remove content that violates the Terms and Conditions, Community Guidelines, applicable law, or a valid intellectual-property complaint.

9.11 Platform Branding and Trademarks

The Fourth Idly name, logo, visual identity, slogans, and other branding elements may constitute trademarks or other protected intellectual property. Users may not use Fourth Idly branding in a manner that implies an unauthorised partnership, sponsorship, endorsement, certification, or official representation.

NGOs, Donors, Volunteers, and other community participants may refer to Fourth Idly factually when describing their participation, provided the reference does not mislead others about affiliation or endorsement.

9.12 Lawful Exceptions and User Rights

Nothing in this Copyright Policy is intended to remove rights that Users or rights holders have under applicable copyright law. Indian copyright law may permit certain uses of copyrighted works without the copyright owner’s permission, depending on the facts and statutory requirements.

Fourth Idly may consider applicable legal exceptions when reviewing a copyright complaint. Users should not assume that every use is infringing merely because the copyright owner did not provide a separate written licence; similarly, Users should not assume that a use is lawful merely because the content is available online.

9.13 Removal and Moderation

Fourth Idly may remove, restrict, or disable access to content where it has a reasonable basis to believe that the content infringes intellectual-property rights, violates the Terms and Conditions or Community Guidelines, creates a legal or safety risk, or is otherwise subject to a lawful removal request.

Content moderation or removal does not necessarily constitute a legal finding of infringement. Fourth Idly may act conservatively to protect Users, rights holders, and the Platform while a matter is being reviewed.

9.14 Evidence and Cooperation

Users involved in a copyright complaint may be asked to provide additional information reasonably necessary to assess the matter. Such information may include proof of ownership, licensing documentation, publication details, permission from a rights holder, or other evidence.

Users must not knowingly submit fabricated evidence, false ownership claims, or misleading statements. Doing so may result in account restrictions and may expose the User to legal consequences under applicable law.

9.15 Contact Details

Copyright complaints, counter-notices, and intellectual-property enquiries should be directed to the official Fourth Idly copyright/legal contact address published by the Platform.

The previous Charitey document specified copyright@charitey.org. That address has intentionally not been carried over because it belongs to the previous organisation and is not an appropriate Fourth Idly contact address.

Once Fourth Idly’s final official copyright/legal email address is confirmed, it should be inserted into this Policy and used consistently across the app, website, Terms and Conditions, Privacy Policy, and other legal notices.

9.16 Policy Updates

Fourth Idly may update this Copyright Policy when the Platform changes, new content features are introduced, applicable intellectual-property law changes, or the complaint and moderation process is revised. Material changes may be communicated through the Platform or other appropriate channels.

Users are encouraged to review the current version periodically, particularly when submitting new types of content such as photographs, impact posts, reports, documents, or other creative material.

9.17 Acknowledgement

By submitting content to Fourth Idly, you acknowledge that you are responsible for ensuring that you have the necessary rights or lawful basis to submit and permit Fourth Idly to use that content as described in this Policy.

By using the Platform, you also agree not to knowingly infringe the intellectual-property rights of Fourth Idly, other Users, NGOs, beneficiaries, third-party service providers, or other rights holders.
