9. Copyright Policy
9.1 Ownership of Platform Content
All intellectual property rights in the Charitey Platform — including the software, design, layout, original written content, logos, graphics, and trademarks — are owned by Charitey or its licensors and are protected under the Copyright Act, 1957 (India) and other applicable intellectual property laws. Unauthorised reproduction, distribution, or modification of Charitey's intellectual property is strictly prohibited.
9.2 User-Generated Content
Users who submit content to the Platform — including photographs of donated goods, NGO activity reports, and descriptions — retain ownership of their original content. By submitting content to Charitey, you grant us a non-exclusive, royalty-free licence to host, display, and reproduce the content in connection with Platform operations. You represent and warrant that:
- You are the original creator of the content or have all necessary rights to submit it.
- The content does not infringe the copyright, trademark, privacy, or other rights of any third party.
- You are authorised to grant the licence described above.
9.3 Copyright Complaints
Charitey respects intellectual property rights and takes copyright infringement seriously. If you believe that content on the Platform infringes your copyright, you may submit a copyright complaint as described below.
9.4 Reporting Copyright Infringement
To file a copyright complaint, please send a written notice to copyright@charitey.org containing the following information:
- A description of the copyrighted work you claim has been infringed.
- A description of the infringing material and its location on the Platform (URL or platform-specific identifier).
- Your full name, postal address, email address, and phone number.
- A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner's behalf.
- Your electronic or physical signature.
- Charitey will review valid complaints promptly and will take appropriate action, including removal of infringing content, where warranted.
9.5 Counter Notice
If content you submitted has been removed as a result of a copyright complaint and you believe the removal was in error, you may submit a counter notice to copyright@charitey.org. The counter notice should include:
- Identification of the removed content and its former location.
- A statement under penalty of perjury that you believe the content was removed by mistake or misidentification.
- Your contact details.
- Your consent to the jurisdiction of the appropriate court.
- Charitey will restore removed content at its discretion upon receipt of a valid counter notice, subject to applicable law.
9.6 Repeat Infringers
Charitey has a policy of terminating accounts of users who are found to be repeat infringers of intellectual property rights. We reserve the right to determine, at our sole discretion, whether a user is a repeat infringer.
