1. Terms and Conditions
2.1 Acceptance of Terms
These Terms and Conditions ('Terms') govern your access to and use of the Charitey Platform operated by Charitey ('we', 'us', 'our'). By accessing, registering on, or using the Platform in any capacity — whether as a visitor, donor, volunteer, or NGO — you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease using the Platform. These Terms constitute a legally binding agreement between you and Charitey. We recommend that you read them carefully and retain a copy for your records. These Terms should be read in conjunction with our Privacy Policy, Community Guidelines, and all other policies published on the Platform.
2.2 Definitions
In these Terms and Conditions:
- 'Platform' means the Charitey website at charitey.org and any future mobile applications or digital services.
- 'User' means any individual or entity accessing or using the Platform.
- 'Account' means a registered user profile created on the Platform.
- 'NGO' means a non-governmental organisation, charitable trust, registered society, or non-profit company verified on the Platform.
- 'Donor' means an individual or corporate entity contributing goods or resources through the Platform.
- 'Volunteer' means an individual registering to offer time or services through the Platform.
- 'Content' means all text, images, data, listings, and other material submitted to or displayed on the Platform.
- 'Donation Listing' means a post by a donor offering specific goods or resources for charitable distribution.
- 'Resource Request' means a post by an NGO describing a need for specific goods, services, or volunteers.
- 'Charitey' means the team, organisation, and legal entity operating the Platform.
2.3 Eligibility
To use the Charitey Platform you must:
- Be at least 18 years of age.
- Be legally capable of entering into a binding agreement.
- Not be prohibited by any applicable law from using the Platform.
- Provide accurate, truthful, and complete information during registration.
- For NGOs: be a validly registered non-profit entity under applicable Indian law.
- Charitey reserves the right to refuse registration to any individual or organisation at its sole discretion, including where eligibility requirements are not met.
2.4 User Accounts
2.4.1 Registration
To access most features of the Platform, you must create an account. During registration, you agree to provide accurate and current information and to keep such information updated. You are solely responsible for all activity that occurs under your account. You must not share your login credentials with any other person or permit any unauthorised access to your account.
Charitey is not liable for any loss or damage arising from your failure to protect your account credentials. If you suspect unauthorised access to your account, you must notify us immediately at security@charitey.org.
2.4.2 Account Verification
Certain account types — particularly NGO accounts — are subject to a verification process. NGOs must submit the documentation described in our NGO Verification Guidelines. Verification does not constitute an endorsement by Charitey of the NGO's activities or financial practices. It indicates only that the submitted documentation has been reviewed in good faith. Charitey reserves the right to revoke verified status at any time if documentation is found to be fraudulent or if the NGO violates these Terms.
2.5 NGO Responsibilities
NGOs registered on the Platform agree to:
- Maintain the accuracy of all information provided in their profile and verification submission.
- Respond promptly to donation offers and volunteer enquiries.
- Use donated goods and resources solely for the stated charitable purpose.
- Not misrepresent the nature, urgency, or recipients of any resource request.
- Notify Charitey immediately of any change in registration status, legal standing, or key personnel.
- Comply with all applicable Indian laws governing non-profit organisations.
- Not use the Platform to collect or redirect financial donations unless Charitey has specifically enabled such functionality.
- Provide Charitey with reasonable evidence of goods received and their intended use upon request.
2.6 Donor Responsibilities
Donors using the Platform agree to:
- Donate only goods that are in a safe, usable, and legal condition.
- Accurately describe the type, quantity, and condition of donated goods.
- Not attempt to donate prohibited, hazardous, expired, counterfeit, or illegal items.
- Complete donation arrangements in a timely manner once a connection has been made.
- Not list the same donation simultaneously on multiple platforms if it creates a risk of double-claiming.
- Treat NGO representatives and volunteers with respect.
- Ensure that goods donated to vulnerable populations (food, medicines, clothing) meet appropriate safety standards.
2.7 Volunteer Responsibilities
Volunteers using the Platform agree to:
- Provide accurate information about their skills, availability, and qualifications.
- Honour commitments made to NGOs in a timely and professional manner.
- Conduct themselves with honesty, respect, and professionalism at all times.
- Not misrepresent their qualifications, particularly for roles requiring specific expertise.
- Report any concerns regarding the conduct of NGOs or other Platform users to Charitey.
- Comply with any applicable health, safety, or legal requirements when performing volunteer activities.
2.8 Acceptable Use
By using the Platform, you agree that you will:
- Use the Platform only for lawful charitable and social impact purposes.
- Not upload or transmit any content that is false, defamatory, misleading, or fraudulent.
- Respect the rights, privacy, and dignity of all other users.
- Comply with all applicable laws and regulations.
- Not attempt to circumvent any security or access control measures.
- Not use the Platform in a manner that could damage or impair its availability or performance.
2.9 Prohibited Activities
The following activities are strictly prohibited on the Charitey Platform:
- Creating false, duplicate, or misleading accounts.
- Misrepresenting your identity, affiliation, or credentials.
- Submitting fraudulent NGO verification documents.
- Using the Platform to solicit financial donations outside of authorised channels.
- Collecting, harvesting, or scraping user data without authorisation.
- Sending unsolicited communications or spam to other users.
- Uploading malicious code, viruses, or harmful content.
- Engaging in or facilitating illegal activities of any kind.
- Discriminating against users on the basis of religion, caste, gender, disability, or any protected characteristic.
- Posting hate speech, obscene content, or material that incites violence.
- Attempting to defraud donors, NGOs, or volunteers.
- Misusing the reporting system to target legitimate users.
- Using the Platform for personal financial gain outside its intended social impact purpose.
2.10 Intellectual Property
2.10.1 Platform Ownership
All intellectual property rights in the Charitey Platform — including but not limited to the name, logo, design, layout, software, code, database structure, and original content — are owned by Charitey or its licensors. Nothing in these Terms constitutes a transfer of any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purpose, subject to these Terms. This licence does not permit you to reproduce, modify, distribute, or create derivative works of any Platform content without prior written consent.
2.10.2 User Content Licence
By submitting content to the Platform, you grant Charitey a non-exclusive, royalty-free, worldwide licence to host, display, and reproduce such content for the purpose of operating and promoting the Platform. You represent and warrant that you have the right to grant this licence and that your content does not infringe the intellectual property or privacy rights of any third party.
2.10.3 Trademarks
'Charitey' and associated logos and marks are trademarks or registered trademarks of the Platform operator. You may not use these marks in any way that implies endorsement, affiliation, or sponsorship by Charitey without prior written consent.
2.11 Donations and Resource Requests
Charitey acts as a facilitator connecting donors with NGOs. We do not own, take possession of, or guarantee the quality of donated goods. We do not verify the condition of items listed by donors and cannot guarantee that any donation will be accepted or that any resource request will be fulfilled. Donors enter into their own arrangements with NGOs regarding the logistics of donation. Charitey bears no liability for loss, damage, or non-delivery of goods. In the event of a dispute between a donor and an NGO, Charitey may attempt to facilitate resolution but is not obligated to do so and is not a party to the transaction.
2.12 Platform Availability
Charitey endeavours to maintain the availability and performance of the Platform at all times. However, we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to:
- Scheduled maintenance and upgrades.
- Unscheduled technical failures or outages.
- Third-party service provider disruptions.
- Force majeure events beyond our control.
- Charitey will use reasonable efforts to minimise disruption and to notify users of planned outages in advance. We are not liable for any loss or inconvenience resulting from Platform unavailability.
2.13 Limitation of Liability
To the fullest extent permitted by applicable law:
- Charitey's total liability to you for any claim arising from or related to your use of the Platform shall not exceed INR 1,000 (Indian Rupees One Thousand).
- Charitey shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including loss of data, revenue, or goodwill.
- Charitey makes no warranties, express or implied, regarding the Platform's fitness for a particular purpose, merchantability, or accuracy of content.
- Charitey is not responsible for the actions, omissions, conduct, or content of any NGO, donor, or volunteer.
- Nothing in these Terms limits liability that cannot be excluded by law, including liability for fraud or death or personal injury caused by negligence.
2.14 Indemnification
You agree to defend, indemnify, and hold harmless Charitey and its directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms.
- Your violation of any applicable law or regulation.
- Content you submit to the Platform.
- Your interaction with another user or NGO.
- Any misrepresentation of your identity or credentials.
2.15 Suspension and Termination
Charitey reserves the right to suspend or permanently terminate your account, with or without prior notice, if:
- You breach these Terms or any Platform policy.
- We reasonably suspect fraudulent or illegal activity.
- You engage in behaviour that is harmful to other users or the Platform.
- Your continued use poses a risk to the security or integrity of the Platform.
Upon termination, your right to access the Platform ceases immediately. Termination does not relieve you of obligations incurred prior to the date of termination, including indemnification obligations. You may appeal termination decisions by contacting grievance@charitey.org.
